Facebook Pics Of Ex GFs Cause Emotional Stress? You Can Sue For That In Tennessee!

tennesseeDo online images of ex girlfriends cause you “emtional stress”? A new law in Tennessee makes it illegal to display or transmit images that “frighten, intimidate or cause emotional distress.”

The constitutionality of the new law seems to be in question, according to Ars Technica, because the “law doesn’t require that the picture be of the “victim,” nor would the government need to prove that you intended the image to be distressing.”

Since the legislation includes a provision giving the government access to social networking sites and communication done on them, the ability to claim distress over pics of exes could fall under the law.

Under this law would the pics of say 9/11 events be illegal?

The law was not detailled enough to create exemptions and is no doubt going to have to be interpreted by the courts.

“The ban on distressing images, which was signed by Gov. Bill Haslam last week, is also an update to existing law. Tennessee law already made it a crime to make phone calls, send emails, or otherwise communicate directly with someone in a manner the sender “reasonably should know” would “cause emotional distress” to the recipient. If the communciation lacked a “legitimate purpose,” the sender faced jail time,” Ars Technica reported.
